Although the Canadian law does not say that making of the WILL is a must, by looking at the consequences of not having a will, it is necessary – both from legal aspect as well from the shari’ah aspect. Canadian Law allows you to have an Islamic Will. If a Canadian Muslim die without a Will, his or her property will be divided according to the rules set out in the Succession Law Reform Act. From an Islamic perspective, your surviving relatives may not receive the shares specified for them in Islam. By not writing a will, you are leaving the door open for a non-Islamic authority to distribute your estate according to its own views.
A Power of Attorney for Personal Care (Health Care Consent Act, 1996.) gives someone the power to make decisions as per your wishes about your care should you become unable to make these decisions. Personal care can include health care, medical treatment, diet, housing, clothing, hygiene, and safety.
